Terms and Conditions (T&C)

1. Scope of Application
These terms and conditions exclusively govern the business relationship between Paul Durstberger (“studiokauli”) and the customer. Any conflicting or deviating terms of the customer are not recognized and are hereby expressly rejected, unless expressly agreed in writing.

2. Conclusion of Contract
The presentation of products in the webshop does not constitute a legally binding offer. By submitting an order, the customer makes a binding offer to conclude a purchase contract. Paul Durstberger (“studiokauli”) accepts this offer by sending an order confirmation via email. The purchase contract is concluded with the order confirmation.

Paul Durstberger (“studiokauli”) reserves the right to review orders that appear to be unusually large or potentially abusive. In such cases, orders may be split, adjusted, or canceled. Customers will be informed immediately if any action is taken regarding their order.

Right of Withdrawal
For products that are not individually manufactured, customers have a statutory right of withdrawal. Details can be found in the separate cancellation policy provided on our website (see “Right of Withdrawal”).

3. Products
Product images in the webshop may differ from the delivered products. Variations in color or size due to screen display or print-on-demand processes do not constitute defects. Paul Durstberger (“studiokauli”) reserves the right to adapt products and implement legal changes.

4. Prices and Shipping Costs
All prices include statutory VAT.

Shipping Costs:

  • Austria: €4.50, free shipping from €89.00
  • Germany: €3.95, free shipping from €89.00
  • Belgium, Netherlands, Luxembourg: €4.00, free shipping from €89.00
  • Other EU countries: €4.00, free shipping from €89.00
  • Worldwide (non-EU): €4.50, free shipping from €89.00

Production & Delivery Times (Shirtigo Fulfillment / Print-on-Demand):

  • Production time: approx. 1–5 business days after order receipt (average: 2 days), embroidery products: 2–4 days
  • Shipping time: country-specific – Germany: 1–2 business days, EU: 2–5 business days, worldwide: depending on destination country and customs clearance

Delivery times may be extended in cases of large orders or unforeseen production/supply bottlenecks.
Partial deliveries are permitted, if reasonable for the customer.

Possible Delays:

  • Delayed transmission of the order to the production system
  • Incomplete or incorrect address data
  • Adjustment of print files or print size
  • Supply bottlenecks for raw materials
  • Quality control (printing/textile defects)
  • Very large orders

5. Payment Terms
Payment is due upon order completion. The following payment methods are available:

  • Credit card: charged automatically after checkout
  • PayPal: payment directly after order confirmation
  • Sofort / Klarna: instant online banking payment in real time
  • Google Pay / Shop Pay / EPS transfer: direct payment at checkout

Payment processing is handled by the respective payment providers. Paul Durstberger (“studiokauli”) has no access to full payment data, only to the information required for order processing.

6. Delivery
All products are produced after order receipt (via external print-on-demand service provider). Average production and delivery times as stated in section 4 apply. If a product is unavailable, delivery will occur no later than 14 days after order.

7. Partial Deliveries
Partial deliveries are permitted, provided they are reasonable for the customer.

8. Warranty / Liability for Defects
Statutory warranty provisions apply. Defects must be reported within the warranty period. Print-on-demand products may show minor deviations due to individual production; such deviations do not constitute defects.

9. Liability
Liability is limited to intent and gross negligence. For simple negligence, liability exists only in cases of breach of essential contractual obligations (“cardinal obligations”) and for damages to life, body, or health. Liability under the Product Liability Act remains unaffected.

10. Data Protection / External Service Providers
Personal data is processed solely for order fulfillment. Further details are available in our Privacy Policy.

External service providers:

  • Shirtigo (production & fulfillment)
  • Payment providers: PayPal, Klarna, credit card providers, Google Pay, Shop Pay, EPS

These companies process personal data on behalf of studiokauli.

11. Applicable Law
Austrian law applies, excluding the UN Convention on Contracts for the International Sale of Goods (CISG).

12. Final Provisions
Should individual provisions be invalid, the validity of the remaining provisions remains unaffected.

13. Liability for External Links
Despite careful control, studiokauli assumes no liability for the content of external links. The operators of linked sites are solely responsible for their content.
